Iain Halliday joined McGill & Co in 2014 after graduating from the University of Glasgow with First-class honours and completing the Diploma in Professional Legal Practice at the University of Aberdeen. He first studied immigration and asylum law during the third year of his law degree, which he spent studying abroad at the University of Helsinki completing further studies in this area of law in his final year of his degree.

During his time at the firm, Iain has: been involved with the preparation and submission of numerous immigration and nationality applications to the Home Office; conducted numerous appeal hearings at the First-tier Tribunal (Immigration & Asylum Chamber) including complex human rights appeals, appeals against deportation, appeals against refusals to issue EEA residence cards, and asylum appeals; has prepared and presented onward appeals to the Upper Tribunal; and has assisted Counsel with actions for judicial review at the Court of Session. He regularly assists clients with complex legal issues ranging from the posting of international workers to family migration problems.

Iain has successfully represented clients facing deportation and removal and regularly processes complicated EEA residency applications, British Nationality applications, and private and family life applications. He has been involved in several cases concerning the best interests of the child. He regularly assists clients with applications to enable them to come to the UK to work or start a business, providing invaluable advice and guidance on the requirements and necessary documents in relation to: Tier 1 (Entrepreneur) applications and, more recently, applications under the new Start Up & Innovator route; Tier 2 applications; and applications to come to the UK as the sole representative of an overseas business.

Iain is a member of the Immigration Law Practitioners’ Association and Vice Convenor of the Law Society of Scotland's Immigration and Asylum Committee. He has been involved in drafting submissions to Parliamentary Committees at both Westminster and Holyrood and has taken a particular interest in the preservation of the rights of EU citizens post-Brexit. In January 2019 he was invited to give oral evidence to the All Party Parliamentary Group on Africa’s inquiry in to refusal of visas to African visitors. Iain also writes regularly for the free movement blog, which provides updates and commentary on UK immigration and asylum law.
